Surgical Robotic Device Malfunctions; Medical Malpractice Suit Filed

A Louisiana woman recently filed a medical malpractice case against Intuitive Surgical Systems, Inc. – the manufacturers of a surgical robotic device that failed during the woman’s neck surgery. According to the lawsuit, the malfunction occurred when the defective medical device was inserted into her neck.

By contract and agreement, Intuitive Surgical Systems is required to have service personnel available at all times in order to rapidly troubleshoot any malfunctions with the device. However, the hospital was unable to contact a representative to fix the problem. As a result, the woman had to convert her robotic transaxillary thyroidectomy into a traditional surgery, which required opening a long incision in her neck.

In the case, Intuitive Surgical Systems is accused of not only faileing to maintain the defective medical device, but failing to adequately train personnel on proper use of the device, and failing to dispatch a technician in a timely manner.

25 Million Bees Released Due to Truck Accident

Louis Holst and his wife Tammie were driving a tractor-trailer that carried 460 bee hives when they reached a sharp turn in a construction zone on I-15 in southern Utah. The turn caused the truck’s trailer to flip, releasing approximately 25 million bees out into the open.

Holst and his wife survived the truck accident, but escaping the bees proved to be the real challenge. Holst took off his shirt and swatted at the air to keep the bees away while his wife made a run for it. Unfortunately, both Holst and his wife were stung around 12 times each, and at least two initial responders were also stung.

The truck’s shipment of bees was the last of 160 truckloads that were carrying a total of 4 million bees to a farm in Bakersfield, California. After the accident, Interstate 15 near St. George was closed for many hours while professional beekeepers tried to wrangle the bees back into their hives. Unfortunately, the majority of the bees died or quickly disappeared after the accident.

Medical Error Causes Patient to Contract Hepatitis C

Despite the fact that the University of Pittsburgh Medical Center (UPMC) is a leading American hospital and health care provider, it is not immune to medical mistakes. Earlier this year, a young man received a kidney transplant from his longtime girlfriend in an operation that was performed at UPMC Presbyterian. Although the surgery was completed without any problems, doctors later discovered that the girlfriend’s donated kidney was infected with hepatitis C.

As a result of this oversight, UPMC’s living kidney donor transplant program was shut down for two months. Both the man and his girlfriend filed medical malpractice lawsuits in response to the hospital’s failure to diagnose the woman’s condition. According to the cases, UPMC overlooked a series of positive test results six times before the surgery took place.

Results from an initial blood test that revealed hepatitis C were available over two months before the transplant took place. To make matters worse, when the woman was finally informed of her infection, a UPMC surgeon apparently suggested to her that she should keep the information from her boyfriend.

Fatal Accidents Now Cost an Average of $6 Million

The auto club AAA recently analyzed the financial damage of traffic accidents in 99 different urban areas, in comparison to the financial cost of traffic congestion. The report concluded that the cost of car accidents is more than three times the amount of congestion: a full $299.5 billion, compared to $97.7 billion for congestion. This puts the average cost of a fatal car accident at around $6 million.

These costs have risen sharply since 2005, which was the last time AAA did a similar study. At that point, the average cost of a car accident fatality was $3.24 million. AAA hopes their study will push road safety back to the forefront of the national debate regarding transportation priorities, as Congress is currently considering a long-term funding bill for national highways.

AAA has made recommendations to reduce the financial cost of car accidents. Among them is a suggestion to invest more in proven safety measures, such as modernized roundabouts, rumble strips, and cable barriers along medians that would prevent crossover accidents.

Car Accident Victims Hold Rally Against Michigan Auto Insurance Changes

A group of car accident victims held a rally today in Southfield, Michigan to take a stand against the car insurance legislation that is currently being considered in Lansing. They are upset about a bill that recently passed the House Insurance Committee a week ago that would change Michigan’s insurance coverage requirements for victims who are injured in car accidents.

Michigan is currently the only state in the nation that requires uncapped medical benefit coverage for victims who are seriously injured in auto accidents. The legislation’s new proposal would allow motorists to purchase less expensive insurance in exchange for a more limited Personal Injury Protection (PIP) policy.

Supporters say motorists should have options for different levels of insurance coverage that fit within their budget, but opponents insist that motorists who opt for less coverage could end up underinsured and in serious financial trouble if they are injured in a car accident.

Worker Dies in Accident at Texas Instruments Facility

This past Monday, Texas firefighters responded to a water purifier explosion that was reported at a Texas Instruments facility in Richardson. According to police, a 54-year-old worker was impaled by glass as a result of the explosion, and is now dead.

A spokeswoman with Texas Instruments stated on Tuesday that the company is still gathering information about the workplace accident, which remains under investigation. The cause of the water purifier explosion is still unknown.

Woman in Wheelchair Struck and Killed by Cement Truck

In the late afternoon on Tuesday, a Glenwood cement truck driver was traveling through the South Side of Chicago and failed to stop at a stop sign. A woman was crossing the street in a motorized wheelchair at the time; the cement truck struck her and caused fatal injuries.

The 60-year-old woman was pronounced dead less than an hour after the pedestrian accident, after being rushed to the John H. Stroger Jr. Hospital in Cook County.  The truck driver has been cited for failure to stop at a stop sign, negligent driving, and striking a pedestrian in the crosswalk. No criminal charges have been brought against him, but the accident is still under investigation.

Motorcyclist Suffers Serious Injuries in Collision With NY Sedan

A collision between a motorcycle and a 2008 Hyundai sedan shut down East Genesee Street in Fayetteville, New York early Monday morning. The motorcyclist – a 33-year-old male from Pennsylvania – was riding his Yamaha eastbound on Route 5 when the Hyundai made a left turn and struck him.

The sedan was being driven by a 47-year-old woman from the Fayetteville area. According to witnesses, she appeared to pull out directly in front of the motorcycle while making her turn, causing the motorcycle accident. The driver of the car remained uninjured, but the motorcyclist was thrown from his bike by the impact.

Motorcyclists are in much more danger of suffering serious injuries in a collision, since their vehicle affords them no external protection. Drunk Driver Strikes Three Pedestrians in Arizona

An unlicensed driver from Las Vegas was traveling on West 39th Street in Yuma when he collided with three pedestrians – one of whom is now in critical condition at a Phoenix hospital. The other two victims of the pedestrian accident sustained injuries, but none that were life-threatening. After being treated at the Yuma Regional Medical Center, they were released.

The Yuma Police Department believes that alcohol was a factor in the accident, and has detained the driver for three counts of aggravated assault. According to Yuma police, the drunk driving accident occurred in the early morning hours. As the pedestrians were crossing the roadway, the 30-year-old driver struck them with his Mercury Grand Marquis.
