Plastic Surgeon Botches Breast Augmentation and Performs Unrequested Eyelid Surgery

Monday, September 26th, 2011

An uncertified Los Angeles plastic surgeon recently performed a failed breast augmentation on a 40-year-old woman, leaving her with breast tissue that touched in the middle and created the look of a single breast, or a ‘uniboob.’ But this wasn’t the surgeon’s only surgical mistake. He also performed corrective eyelid surgery on the woman, despite the fact that she had not requested any such procedure.

To make matters worse, the eyelid surgery was also a failure, leaving the woman unable to close her eyes. The woman has sued the surgeon for medical malpractice and collected a settlement which she used for corrective breast surgery, but doctors say that no amount of corrective surgery will be able to repair the damage to her eyelids. She now must take eye medication for the rest of her life in order to keep her eyes from drying out.

When a surgeon makes such a critical error during a routine surgery, and then performs a second procedure without the patient’s permission, this qualifies as serious medical malpractice. We trust physicians to adhere to the highest standards of medical ethics and conduct when performing invasive operations. When a physician shows blatant disregard for that standard of care, they can and should be held accountable for negligence.

Concussion Leads to Teen’s Disappearance

Friday, September 23rd, 2011

A Massachusetts teenager went missing last Tuesday under unusual circumstances. Investigators believe his disappearance is a direct result of a concussion he suffered over a year ago while playing high school football. New policies governing high school sports require players to be removed from a game on a much stricter basis – they must be examined by a specialist and benched if they show even mild signs of dizziness. If the staff does not adhere to this policy, they can be held responsible for negligence.

The Wrentham Police Department stated that the teen was negative for drug abuse and alcohol, further lending weight to the theory that his disappearance is related to his traumatic brain injury. The injury has already caused him to black-out twice at school. Specialists say that elements of stress, a change in circumstances, and a change in medication can all trigger a relapse.

The boy finally re-appeared on a doorstep in Dedham stating that he had been kidnapped. He seemed disoriented and didn’t have shoes on, but otherwise appeared unharmed. He was confused and did not recall exactly what happened during the two days he was missing.

If your child suffered a brain injury while playing high school sports and they were not sufficiently examined or taken out of active play for safety, you may be entitled to compensation. Contact an experienced brain injury lawyer in your area today to see if you have a case.

Dump Truck Lands on Car in Pennsylvania Crash

Monday, September 19th, 2011

A seventy-year-old woman was driving on Route 8 in Pennsylvania’s Butler County this past Thursday when she became involved in a chain-reaction truck accident that occurred in front of Clearview Mall. A tri-axle dump truck ended up landing on top of her car. It took firefighters 45 minutes to free the woman from her totaled vehicle, but incredibly, she was still conscious and alert. She did, however, suffer from broken ribs and a broken pelvis.

Police are still looking for the driver of the vehicle that caused the accident. Witnesses say a car was making a left turn in front of the woman’s car and the dump truck when the accident occurred. According to those at the scene, there was “practically nothing left” of the woman’s car after the accident.

Victims of car accidents aren’t always so lucky. Traumatic brain injury, spinal cord injury, and other catastrophic personal injuries are common consequences of a serious wreck, impacting a person’s future for years to come. When reckless drivers endanger other people’s lives, they can and should be held accountable.

Verizon Worker Dies While Working on Power Lines

Thursday, September 15th, 2011

According to local officials, the 37-year-old employee was inside of a cherry picker when the accident occurred, working on a series of power lines that connected to an electrical pole. He was trying to run the cable, but somehow got caught on the power cable, remaining on the lien for close to a minute. Witnesses heard a pop as his body caught on fire.

Firefighters rushed to the scene, but were too late. A Verizon spokesman says he does  not know how the worker came into contact with the power lines. Investigations are still underway, led by Verizon and the Occupational Safety and Health Administration (OSHA).

Physicians With Multiple Malpractice Claims Are Keeping Licenses

Tuesday, September 13th, 2011

The most central maxim of medical ethics is: “First, do no harm.” Medical students in America are taught that whenever they face a health problem, it is usually best to pursue an alternative treatment option – or even do nothing at all – rather than risk causing more harm.

Even excellent doctors can make mistakes from time to time that cost patients dearly. This is what medical malpractice lawsuits are designed to address. But when a physician is repeatedly taken to court to respond to malpractice claims, is there any accountability?

Unfortunately, the answer seems to be a resounding “no.” Even after a doctor has accumulated an extensive history of medical malpractice, many state licensing boards continually allow them to continue practicing with no interference. In a recent investigation performed by The Kansas City Star, many doctors with significant medical malpractice histories were still practicing with an unblemished medical license – nothing, not even pending disciplinary actions from licensing boards, showed up on their records when searched. In most situations, patients cannot even review a physician’s malpractice records prior to undergoing a surgery or procedure.

If you or one of your loved ones has been injured because of a medical professional’s negligence, you may be entitled to compensation. Contact us today to locate an experienced medical malpractice attorney in your area.

Uninsured Drivers Cause Problems for Florida Motorists

Thursday, September 8th, 2011

If you are involved in a car accident in Florida, the chances are now almost 1 in 4 that the other motorist will not have the insurance to cover your injuries and losses. This revealing statistic comes from a new national study performed by the Insurance Research Council, which estimates that a full 24% of Florida’s drivers are uninsured.

The percentage puts Florida in the top five states with the most uninsured drivers – alongside states like New Mexico, Mississippi, Tennessee, and Oklahoma. Despite the fact that many states have laws requiring drivers to maintain adequate insurance, around 1 in 7 motorists nationwide remain uninsured, forcing responsible drivers to carry the burden of their injuries and losses in an accident.

In Florida, drivers are required to have personal injury protection (PIP) coverage, which protects them for up to $10,000 of their own injuries, no matter who is at fault for an accident. However, unlike the majority of states, Florida doesn’t require drivers to have insurance that covers bodily injuries for the other people involved in the accident.

If you have been involved in an accident with an uninsured or underinsured driver, the experienced Florida car accident attorneys at Ellis, Ged & Bodden, PA can help. Contact them today to schedule a free initial consultation.

Woman on Motorcycle Dies While Pulled Over at Speed Trap

Tuesday, September 6th, 2011

This past Sunday, a Florida couple on a motorcycle were pulled over by a police officer at a speed trap on a local highway. While the motorcycle was still in the process of pulling over, a black pickup truck slammed into the back of it, killing the 48-year-old woman on board. Both the driver and his wife were wearing helmets when the motorcycle accident occurred.

According to witnesses, the motorcycle was being waved over to the side of the road by police. As the motorcyclist proceeded to slow down, the pickup truck following him failed to observe the change in speed. Although the truck driver was not texting or intoxicated, authorities say he is solely responsible for the wreck.

Many of the victim’s friends question the methods of the police officers who were waving the motorcycle over. Instead of being inside their own vehicle and using their lights to alert other motorists to what was happening, they created the opportunity for this tragic accident.

If you have been seriously injured, or if your loved one has been killed in a Florida motorcycle accident, make sure you are getting the justice and compensation you deserve. Contact the experienced Florida motorcycle accident attorneys at Best & Anderson, PA today to schedule your free initial consultation.
