Ohio Worker in Critical Condition After Apartment Complex Explosion

Thursday, April 28th, 2011

An Ohio maintenance worker was seriously injured on Tuesday night by an unexpected natural gas explosion in a Newark apartment complex. The premises liability explosion took place in the boiler room of the complex. The Newark Fire Department was called to the scene late at night, but the maintenance worker had already suffered critical injuries. He was taken by helicopter to the Ohio State University Medical Center.

According to the Assistant Newark Fire Chief, a friend of the worker who joined him was also hurt, but he was able to be treated at the scene by paramedics. Investigators are currently trying to determine if a natural gas leak led to the explosion, as it is believed that the worker was attempting to re-light a furnace in the complex when the explosion occurred.

When workers are invited to visit a property, they have a reasonable expectation that the premises will be safe for them to attend to. When obvious safety problems or lack of maintenance compromise that trust, or the responsible parties do not inform them of an inherent danger, they may be entitled to compensation.

6-Year-Old Girl Injured in DUI Motorcycle Crash

Tuesday, April 26th, 2011

This past Sunday evening, a 47-year-old New Hampshire man driving on Chester Road struck a motorcycle carrying a young girl and her grandfather. The 6-year-old girl was taken to the Boston Children’s Hospital with a serious leg injury. Her grandfather sustained both leg and chest injuries, but was listed in fair condition by Exeter Hospital as of Monday afternoon.

Police arrested the driver and charged him with aggravated driving under the influence (DUI). The driver called 911 himself because of his remorse about the crash, and admitted to crossing the center line on Chester Road – an area that neighbors have described as “tricky with blind curves.”

Drunk drivers never intend to harm anyone on the road, but all the same, their choice to get behind the wheel when intoxicated is their choice alone, and the reckless endangerment that follows is their responsibility.

If you or one of your loved ones has been injured in a car accident caused by a drunk driver in New Hampshire, please contact the experienced DUI crash attorneys at Cullenberg & Tensen today to schedule a confidential consultation.

New York Bus Safety Investigated After Deadly Crash

Wednesday, April 20th, 2011

A fatal tour bus crash last month on a Bronx highway left 15 people dead. Since then, state transportation has cracked down on bus safety, taking 124 bus drivers and 96 buses off of New York roads. Authorities say that since the heightened enforcement and investigation began, police have issued over 150 moving violation tickets to bus drivers.

The two most common problems cited by investigators involved drivers who lied about getting enough rest, and buses with faulty brakes. One of the more egregious offenses was a bus in North Carolina where the driver had falsified his log book. Another alarming discovery was a driver who was operating a bus without a commercial driver’s license, and without a certificate showing that he had passed a required federal Department of Transportation exam. To add insult to injury, this driver’s bus had a leak in the brake hose, leaking engine fluid and transmission fluid, a loose battery, and a dead light over the rear license plate.

The National Transportation Safety Board in Washington, D.C. stated that its administration is now “aggressively enforcing the law,” operating under a zero tolerance policy and sidelining unsafe drivers and equipment. “New Yorkers [need to] have confidence in the safety of the public transportation system,” the governor said in a recent statement.

If you have been injured in a bus accident in New York, you may be entitled to compensation. Please contact the experienced bus accident attorneys at Silberstein, Awad & Miklos, PC today to schedule a free initial consultation.

12-Year-Old Illinois Girl Dies in Fatal Crash

Monday, April 18th, 2011

A deadly auto accident in Fairview Heights, Illinois took the life of a twelve-year-old passenger on Saturday morning. The girl’s mother was transported to St. Louis University Hospital with extensive injuries, but was released Saturday afternoon.

The wrongful death occurred when a young man drove his vehicle over the median and hit the other car head-on. Police believe that drugs may have been a factor in the crash, and are asking prosecutors to consider aggravated homicide and DUI-related charges.

The middle school the girl attended plans to have social workers, guidance counselors, and meetings at the start of the school week to help teachers and students alike cope with this tragedy.

Accidents are always sudden and unexpected, but when an individual chooses to drive under the influence, the word “accident” no longer applies. Tragedies like this one are all the more tragic when they could have been prevented.

If one of your loved ones was killed in a car accident in Illinois because of another person’s negligence or wrongdoing, you deserve justice and compensation to help you cope through this difficult time. Construction Employee Killed in New York Tunnel Accident

Wednesday, April 13th, 2011

An employee for Southland Contracting was working in a tunnel below Lake Ontario when a locomotive carrying debris from the drilling process struck him. The Medical Examiner’s Office pronounced the man dead at the scene. He has yet to be identified, and representatives of Southland Contracting have failed to return calls regarding the construction accident.

Work at the site stopped indefinitely on Monday as the Office of Safety and Health Administration proceeded to conduct an investigation. Though four other workers were in the tunnel with the victim, no one else sustained injuries. The construction site is the future home of the East Side Water Supply Project, contracted by the state in January 2010. The tunnel serves as a go-between for an inland shaft on Lake Road, and another shaft in Lake Ontario.

The accident has put several other local construction companies on alert for the safety of their employees and work environments. Frequent meetings and case-by-case safety instructions are key for any company’s workplace safety.

If you have been seriously injured in a construction or workplace accident in New York and you believe it was due to another party’s negligence, you may be entitled to compensation. Please contact the experienced New York construction accident attorneys at Trief & Olk today to discuss your case.

Wisconsin Reduces Auto Insurance Minimums

Monday, April 11th, 2011

The Wisconsin State Senate recently announced a reduction in the minimum limits required for car accident insurance in the state. Prior limits, established in 2009, included a $50,000 coverage level for accidents resulting in serious personal injury or the death of a single individual, $100,000 of coverage for multiple individuals meeting the same criteria, and $15,000 of coverage for property damages.

The new bill (AB 4) proposes reducing these limits back to the amounts established before 2009, including:

  • $25,000 for bodily injury
  • $50,000 for multiple individuals
  • $10,000 for damage to property

While this reduction is designed to make coverage limits more affordable for individuals who might not be capable of paying the higher premiums, it also means that accidents resulting in bodily injury or death may exceed the lower limits very quickly, resulting in costs and penalties that the policy owner alone is held liable for paying.

If you have been seriously injured in a car accident, or if one of your loved ones has been killed in a fatal auto accident due to another party’s negligence or wrongdoing, the financial fallout can be devastating.

Obtaining the compensation you deserve is the most important step you can take in facilitating a proper recovery. Please contact the experienced auto accident and wrongful death attorneys at the Cochran Firm Wisconsin today to schedule your free case evaluation.

Third Bus Crash in a Month Injures Dozens of NH Residents

Wednesday, April 6th, 2011

After two other Northeastern bus accidents in early March that killed a total of 17 people, a third crash occurred late last week, involving a tour bus that flipped over on an icy New Hampshire highway.  So far, no passengers have died, although five of them were taken to the hospital in serious condition, and several others sustained minor injuries.

The bus was operated by PRT Tours, based in New Jersey, and was carrying South Korean sightseers on the highway from Quebec to Boston. The driver reportedly lost control due to icy road conditions and plowed over a nearby embankment, turning onto its side.

Though weather may have been the most significant factor in the accident, transportation investigators are nevertheless cracking down on discount bus operators after the recent slew of crashes. A number of motor coaches are being taken off the road for spot checks and inspections.

Public bus operators have a responsibility to keep their vehicles in safe working condition, and to take extreme precautions when driving in severe weather conditions. Dozens of passengers’ lives depend on it.

Virginia Port Worker Dies in Forklift Accident

Tuesday, April 5th, 2011

A 38-year-old female port worker was struck and killed by a forklift on Monday morning at APM Terminals in Portsmouth, Virginia. A spokesperson with the port authority stated that the employee was working as a “slinger” – a guide to the crane operator – when the forklift struck her. She died shortly after sustaining serious injuries.

The Portsmouth Police Department reports that the man operating the forklift had his vision obstructed by containers when he struck the woman. Both the victim and the forklift operator worked for Ceres Terminals Incorporated. An investigation is still ongoing.

Employees who work jobs with a high level of physical risk need to adhere to equally high standards of safety. No action should be taken if a person’s vision is obstructed, or if an area is not totally clear of all obstacles. If a worker fails to take these necessary precautions, they can be held liable for the consequences of their actions.

If one of your family members has died as the result of another person’s negligence or wrongdoing, you may be entitled to compensation. Please contact the experienced Virginia wrongful death attorneys at Kalfus & Nachman today to schedule your free consultation.
